Family service rates capped, with child exceptions

Beginning July 11, 2025, West Virginia limits court-ordered service rates in Chapter 49 child welfare cases. Courts can order the Department of Human Services to pay for professional services, such as therapy, at Medicaid rates. Courts can also order payment for socially necessary services at department-set rates, using providers that meet state requirements. Courts cannot order higher rates for adults. For children, courts can order higher rates when services are not provided within 30 days. Professional services qualify for this exception only when Medicaid covers the service. The department can object and request a hearing; courts must give written factual findings and legal reasons supporting higher-rate decisions. Professional service providers receive payment after completing services and submitting required reports or records.
