Limits on public access to military records

West Virginia’s public records law now exempts certain military and security records. Agencies can withhold classified security information; vulnerability or response plans; inventories and related data; communication codes; and deployment plans from the Department of Defense, the U.S. armed forces, the National Guard, or the Department of Homeland Security. They can also withhold specific intelligence or investigative records about terrorist acts or threats that are shared among law‑enforcement and homeland security agencies. Sensitive details like deployment or emergency response plans, tactics, rules of engagement, critical infrastructure security information, or personnel and equipment locations are kept private to protect public safety and service members.
