Bill Overview

Analyzed Economic Effects

4 provisions identified: 0 benefits, 1 costs, 3 mixed.

Extra proof for carbon storage fees

The law authorizes the carbon dioxide sequestration fee schedule rule filed July 24, 2025 and refiled January 8, 2026 after committee changes. It requires parties to submit other evidence of fair market value the Commission requests in section 4.7.1. Fee payers must provide extra documentation. Households are not directly affected.

Change to one water quality limit

The law authorizes updated water quality standards filed July 24, 2025 and refiled January 8, 2026 after committee changes. It replaces the number 20 with 120 in subsection 8.23. Regulators and permit holders must follow the new limit and adjust monitoring or permits. People who use affected waters may see changes in protection levels over time.

Stronger air rules for polluting facilities

The law lets DEP enforce seven updated air rules filed in the State Register on July 22–23, 2025. They cover ambient air standards, startup and shutdown limits, new‑source performance, solid‑waste burning, hazardous‑waste facilities, hazardous air pollutants, and cross‑state NOx and SO2 controls. Facilities that emit air pollution must meet these requirements. Communities statewide get stronger air protections and may breathe cleaner air over time.

Updated hazardous waste management rules

The law authorizes the hazardous waste management system rule under state code §22-18-6. Regulated hazardous‑waste handlers and facilities must follow updated management requirements. This aims to protect communities and the environment. Businesses may face added compliance steps and costs.
