2 provisions identified: 1 benefits, 1 costs, 0 mixed.
Beginning August 1, 2025, West Virginia doctors, physician assistants, and advanced practice nurses cannot provide covered gender-transition treatments to people under 18. This includes gender-reassignment surgery, puberty blockers, and specified hormone doses above normal body levels. Exceptions cover specified care for medically verified sex-development disorders and treatment of conditions caused or worsened by transition procedures. Another exception covers procedures a doctor certifies are needed to prevent imminent death or damage to a major bodily function. Licensing boards must immediately revoke a covered provider’s license for violating these limits.
Beginning August 1, 2025, people can raise actual or threatened violations of the minor-treatment restrictions in court or agency proceedings. They can use violations as a claim or defense and seek compensation, court orders or rulings, reasonable attorney fees, and other appropriate relief. The West Virginia Attorney General can also bring enforcement actions. Claims generally must be filed within two years after the claim arises. Minors can sue through a parent or guardian before age 18. After turning 18, they can sue in their own name until 20 years after that birthday.
