West Virginia police and campus police can give short-term help to other state or federal agencies when asked in writing. In emergencies with risk of death or serious injury, they can help without a written request. Agencies can also ask adjoining states for help in writing. Agencies may form task forces with federal, state, county, and city partners. These teams can share officers, including undercover, equipment, training, and information to investigate crime and help victims.
Officers assigned to another agency get the same powers and legal protections as if they worked there. They follow the receiving agency’s lawful commands but keep pay and personnel control with their home agency. They keep their employee rights and benefits, including workers’ compensation. Civil service protections and existing jurisdiction rules stay the same unless this law says otherwise. The law does not allow permanent mergers or eliminations of police agencies or campus police.
Agency heads must follow all state and local laws and policies while giving assistance. An agreement is not effective until a copy is filed with the circuit clerk in the counties where the agencies operate. Filed agreements can be sealed, but a circuit court can order disclosure for good cause. Agreements stay in effect until changed or withdrawn in writing. Any agency head may withdraw at any time.
