The law creates a Court Security Fund under the Supreme Court of Appeals. Magistrate and circuit court clerks must send fees and costs for this fund to the State Treasury by the 10th day of each month. Spending from the fund requires a legislative appropriation. Money in the fund can pay only for approved court security improvements and for the Supreme Court’s costs to run the fund. Administrative costs are capped at the lesser of 3% of yearly deposits or $30,000 per fiscal year. The fund may also receive gifts, grants, and contributions. Excess balances can be moved to other state accounts only by a legislative appropriation, and after June 30, 2000, amounts may be sent to the Domestic Violence Legal Services Fund as directed by the Legislature.
The law creates a Court Security Board to decide spending from the Court Security Fund. It has six appointed members, and the Supreme Court’s administrative director serves as chair. Seats include a circuit judge, a magistrate, a family court judge, a lawyer, a county representative, and a sheriff representative. Members serve four-year terms and may not serve more than three in a row; vacancies are filled the same way as the original seat. The board must keep a list of certified law‑enforcement officers who can serve as bailiffs and share it with county sheriffs to hire temporary, part-time, or occasional bailiffs.
