Anyone who objects to a sealed voting machine must file in the county district court within 5 days after sealing. The complaint must list the machine number and the reason. If filed before the election, the complaint must be certified.
County clerks must post notice at least 2 days before a test, or 24 hours before a re‑test, in the office and on the county website. For voting machine preparation, clerks must also notify each party’s county chair and all independent candidates in writing. For electronic system tests, clerks must notify each party’s state and county chairs in writing. Party and independent candidate representatives may observe. Clerks must admit at least 3 public observers and may limit attendance to keep the test orderly.
The Secretary of State may set rules for electronic voting systems and their testing. Rules must keep elections fair and accurate. Rules may allow vendor maintenance steps that do not conflict with law. The Secretary must consult county clerks before adopting rules.
Before each election, every voting machine is tested by itself. Counters are set to zero, test votes are cast until they register correctly, then machines are reset, locked, and sealed with a numbered seal. Clerks record the serial number, counter readings, and seal number on a certificate, file it with the Secretary of State, and keep a copy. At least 2 weeks before each election, counties test tabulators with preaudited ballots for every ballot style, including undervotes, overvotes, and, if used, ballots made by ballot‑marking devices. Any errors must be fixed and an errorless count certified. Results are kept, posted on the county website, provided on request, and all test materials are sealed and retained; seals may be broken only for a re‑test.
