Grandfathering and April 2026 permit cutoff
If you had a skill game before September 14, 2022 at a place that did not meet the establishment definition on April 1, 2023, you may keep operating if you follow all other rules. If you had a game before April 1, 2026 at a place that did not meet the definition on April 1, 2026, you may keep operating only until your current permit expires. Starting April 1, 2026, non‑establishment locations cannot renew permits, except for the earlier 2022/2023 grandfathered sites.
Which businesses can host skill games
The law tightens where skill games can be. Games may only be in an "establishment." An establishment is a single business location that is a truck stop, a smoke shop, or is licensed to sell alcohol for on‑site drinking. Some places now qualify, while others no longer do. Operators may need to move games or stop at locations that do not meet the definition.
Skill games limited to 21+ areas
If your place sells alcohol for on‑site drinking, skill games must sit only in the area where alcohol is sold. You cannot place a game in any area where people under 21 may enter. You must clearly mark each game area as age‑restricted. You must not allow anyone under 21 to play.
