RELATING TO INSURANCE FOR HAWAII CONDOMINIUM PROPERTIES.

Requires property insurers to offer discounts on a condominium association's annual insurance premium if the association adopts specific risk mitigation upgrades or develops comprehensive disaster response plans. Requires property insurers of condominiums to base premium increases on actuarial justifications that reflect actual risk reduction resulting from upgraded fire safety improvements installed in conjunction with a building fire and life safety evaluation. Requires property insurers of condominiums to justify premium increases above 10%. Requires property insurers of condominiums to publicly report premium increases each year.

Repeals the requirement to use the Hawaii ABLE Savings Program Trust Fund if the Director elects to accept deposits from contributors instead of sending deposits directly to the ABLE program manager. Authorizes the Director of Finance to expend moneys in the trust fund to provide incentive payments to Hawaii public school ABLE account owners. Appropriates funds for incentive payments to Hawaii public school ABLE account owners and to fund a position to provide statewide outreach, advocacy, and relationship management for the Hawaii ABLE Savings Program.

Requires the Hawaii State Energy Office to conduct a study to identify the most cost-effective investments for clean energy alternatives to combustible fuels. Requires a report to the Legislature.

Allows for the interest earned on payments under protest in the litigated claims fund to be paid in nontaxation cases if the claimant prevails. Establishes a procedure for the disposition of moneys and refiling of actions when a payment under protest suit is filed prematurely. (SD1)

RELATING TO OVERDOSE PREVENTION.

Establishes and provides criteria for overdose prevention centers, including standards for the Department of Health to designate certain facilities as overdose prevention centers. Provides immunity from state criminal prosecution for certain offenses for persons using a designated overdose prevention center and persons operating a designated overdose prevention center.

RELATING TO STATE LICENSED CARE FACILITIES.

Requires the Department of Health to post on its website an easily understandable, searchable, and sortable list of all state-licensed care facilities including information on their licenses and inspections. Requires that the list be updated within five days of any change in its information.

RELATING TO CHILD ABUSE.

Amends the definition of "child abuse or neglect" to clarify that the failure to provide certain needs to a child shall not constitute child abuse or neglect if the sole reason the person responsible for the care of the child is unable to adequately provide for the child's care is lack of financial resources; and evidence of parental request for support shall not be deemed as evidence of child abuse and neglect. Requires the Department of Human Services to establish and implement a Child Care Provider Subsidy and Bonus Program to provide subsidies to retain the existing child care workforce in licensed infant and toddler child care centers, group child care centers, and group child care homes and bonuses to registered family child care homes. Increases the minimum age to operate a low-speed electric bicycle from fifteen to sixteen years of age.

Amends the income tax bracket for taxpayers filing a joint return and surviving spouses to exempt those taxpayers whose taxable income is $200,000 or less. Amends the income tax bracket for unmarried individuals and married individuals who do not file a joint tax return with their spouse to exempt those taxpayers whose taxable incomes is $100,000 or less.

Restricts motor vehicles that tow a motor vehicle or trailer from the far left lane on roads with three or more lanes going in the same direction with exemptions. RELATING TO PROPERTY RIGHTS.

Establishes a procedure for immediately removing an unlawful occupant of a dwelling or premises with assistance from law enforcement. Provides that an unlawful occupant of a dwelling or premises is civilly liable for unpaid utility bills. Provides that a person who trespasses in or upon a dwelling or premises and intentionally or knowingly damages property in an amount exceeding $999 commits a felony of criminal property damage in the second degree. Requires the Department of the Attorney General to develop, publish, and make available a complaint form to remove unlawful occupants of residential dwellings. Effective 7/1/3000. (HD1)

Effective 7/1/2027, establishes the Environmental Stewardship Fee Program within the Department of Land and Natural Resources, through which the Department will collect a fee from visitors for a license to visit a state park, forest, hiking trail, or other state natural area. Establishes the Environmental Stewardship Fee Special Fund effective 7/1/2025. Allocates a certain amount of transient accommodations tax revenues to the special fund. Requires report to the Legislature on strategic plan and timetable for objectives and implementation of the environmental stewardship fee program. Appropriates funds for the environmental stewardship fee strategic plan and positions for the Environmental Stewardship Fee Program.

Allows the Department of Land and Natural Resources to contract or form a partnership with private parties to assist with the maintenance and management of sunscreen dispensers at all state beaches, as well as publicize that the mineral-based sunscreen in these dispensers is more protective of the coral reefs of the State. Appropriates funds for the installation, maintenance, management, and operation of non-chemical sunscreen dispensers on all state beaches.
