Title 10 › Subtitle A — General Military Law › PART II — PERSONNEL › CHAPTER 55 — MEDICAL AND DENTAL CARE › § 1076c
The Secretary of Defense must set up a dental insurance plan for uniformed services retirees, certain unremarried surviving spouses, and their dependents. The Secretary can also meet this duty by letting those people join a similar federal dental plan run by the Office of Personnel Management. People who can join include retirees who get retired pay, Retired Reserve members who would get retired pay but are under 60, eligible dependents, some dependents of members who aren’t enrolled for specific reasons, and unremarried surviving spouses and child dependents of members who died while retired, in the Retired Reserve, or on active duty for more than 30 days. The plan must cover common dental care such as exams, preventive care, fillings and root canals, surgery, and emergency care. Enrollees must pay premiums. The Secretary will set how premiums are collected and, when possible, take them from retired pay. The Secretary will set a minimum enrollment period and allow voluntary sign-up for self only or self plus dependents. Enrollment ends if a retiree loses retired pay, a Retired Reserve member leaves that status, or a surviving spouse remarries. Dependent coverage continues through the paid enrollment period and can be renewed if premiums keep being paid. New regulations will govern the plan. Enrollees get up to 30 days at the start to cancel, and limited exceptions allow later cancellation (for moves, serious medical problems, severe financial hardship, or other approved reasons). Appeals of denial go to the TRICARE Management Activity. Definitions: “eligible dependent” (certain family members), “eligible child dependent” (certain child family members), and “retired pay” (includes retainer pay).
