When a reserve commissioned officer (not a commissioned warrant officer) is moved into the Retired Reserve, they must be placed on their service’s retired list at the highest rank they served satisfactorily. The Secretary of that service decides the rank and applies section 1370a, unless another law gives them a higher rank. If a retired commissioned officer is recalled to active duty in the Selected Reserve under section 10145(d) and serves at least two years, their retired rank is adjusted under section 1370a. The Secretary may shorten the two‑year requirement to one year for officers recalled to serve as adjutant general or assistant adjutant general under title 32 section 314 if they complete at least one year and fail to reach two years only because their appointment ended under title 32 section 324(b).
