Title 10 › Subtitle Subtitle E— Reserve Components › Part III— PROMOTION AND RETENTION OF OFFICERS ON THE RESERVE ACTIVE-STATUS LIST › Chapter 1403— SELECTION BOARDS › § 14104
Do not share the meetings or proceedings of a selection board set up under sections 14101 or 14502 with anyone who is not a board member, except when needed to handle the board’s report. That protection is a legal exemption under 5 U.S.C. 552(b)(3). Talks, deliberations, and any written records from those boards cannot be forced into court, cannot be used as evidence, and cannot be used in any legal or administrative case unless the Secretary of the military department involved gives permission. This rule applies to all such boards, no matter when they met.
