Title 10 › Subtitle Subtitle E— Reserve Components › Part III— PROMOTION AND RETENTION OF OFFICERS ON THE RESERVE ACTIVE-STATUS LIST › Chapter 1409— CONTINUATION OF OFFICERS ON THE RESERVE ACTIVE-STATUS LIST AND SELECTIVE EARLY REMOVAL › § 14702
The military department secretary may, with the officer’s consent, keep certain officers on the reserve active‑status list even if other rules would remove them. This applies to officers in the ranks of major, lieutenant colonel, colonel, or brigadier general who are Army National Guard members assigned to a State headquarters or detachment, or who are Army or Air Force reserve officers required to stay in a Selected Reserve unit to keep a technician job. Those officers can only stay on the list while they still meet those assignment or job conditions. None may be kept on the list after the last day of the month in which they turn 62.
