The Secretary of Defense must put active-duty service members and their dependents first when deciding to open a commissary or pick its location. When choosing how big a store should be, the Secretary must look at how many authorized patrons are likely to use it. Before closing a commissary, the Secretary must make the effect on those service members and dependents and the well-being and safety of the military community a main factor, and must also consider reserve members. A closure in the United States cannot take effect until 90 days after the Secretary sends Congress a written notice explaining the reasons and the expected impact on service members and the community. That 90-day rule does not apply when a commissary closes because its base is closed under a base closure law.
