Title 10 › Subtitle A — General Military Law › PART IV — SERVICE, SUPPLY, AND PROPERTY › CHAPTER 169 — MILITARY CONSTRUCTION AND MILITARY FAMILY HOUSING › SUBCHAPTER V — OVERSIGHT OF LANDLORDS AND PROTECTIONS AND RESPONSIBILITIES FOR TENANTS OF PRIVATIZED MILITARY HOUSING › § 2894
Military departments must set up one standard process to quickly and fairly settle disputes between landlords and tenants in military housing. The process covers things like repairs, maintenance, damage claims, rent, move-out charges, and similar housing issues. Tenants can ask to have certain payments held back while a case is decided. The installation or regional commander is the person who makes the final decision. Tenants can file online or other ways, get help from a military housing advocate or legal assistance, pay little or no cost, and have the dispute added to the complaint database. Within 2 business days of a tenant’s request, the office must tell the tenant they got it, send copies to the commander, housing office, and landlord, and start any requested withholding. The housing office must inspect and report in 7 business days. The commander must ask for input from the housing chief, landlord, tenant, a judge advocate or federal attorney, and a civil engineer if it’s a facilities issue. A decision must be made within 30 calendar days (up to 60 in limited cases) and is final. If the commander orders fixes, the landlord gets at least 10 business days to comply. If the landlord fails to fix things, payments to the landlord are cut by 10% for each 5 calendar days the problem remains. Withheld payments can include BAH under section 403 of title 37 and pay sent by allotment under section 2882(c) of this title, but only for the time the landlord failed maintenance rules or the unit is uninhabitable under state or local law. New leases must give tenants written notice and an addendum explaining the process. Tenants may still bring claims to other courts or bodies that have authority.
