If a military department Secretary finds credible bad information about someone a promotion board recommended for a rank at or below major general (or rear admiral in the Navy), and that information was not given to the promotion board, the Secretary must set up a special selection review board under section 628(f) to recheck the person and decide whether to keep the promotion recommendation. The Secretary may instead wait and bring the information to the next regular promotion board. While under review, the person’s name must not be put on the public list of recommended officers and must not be sent for appointment or nomination to the Secretary of Defense, the President, or the Senate. The review board can look at as many people as the Secretary sends it. The board must get the same records the original promotion board had and any new adverse information. The person must be given that information and a reasonable chance to comment before the board meets. If information is classified, the person should get an appropriate summary. If the person already saw the information and commented to the original promotion board, those comments go to the review board. The review compares the person’s file to samples of officers who were recommended and not recommended, in a way that hides who is under review. To keep the promotion, the person must rank in the top half or be judged better than the highest non-recommended sample officer and be similar to those recommended. A majority of the board must agree. If the board recommends keeping the promotion and the President approves, the person is appointed as soon as practicable with the same date of rank, pay start date, and place on the active list they would have had before. The Secretary of Defense must write uniform rules to run these reviews, and any extra rules from a military department need the Secretary of Defense’s written approval.
