§20251 Failure of Selection for Promotion

Summary

Apply the promotion rules in sections 14501, 14503, 14504, 631, and 632 to officers on the Space Force list, with a few changes. Where those rules mention the reserve active-status list or the active-duty list, they mean the Space Force officer list. Where those rules mention promotion boards under sections 14201 or 611, they mean boards under section 20211. The part of section 14501 about an "officer above the promotion zone" does not apply to Space Force promotions. For retirement rules in sections 631 and 632, the phrase about qualifying for retirement is read to mean qualifying under any law except chapter 61. A Space Force officer is not counted as having failed promotion twice for the purposes of section 629(e)(2) or 14501(b) until the officer has used the maximum number of promotion attempts allowed for that grade and competitive category under section 20234. Any place that refers to failing promotion a second time (including sections 631(a), 632(a), and 14504–14506) should be read to mean failing the maximum number of times set in section 20234.
