A person who filed the case can change it to chapter 7 at any time. Any agreement that tries to take away that right is not valid. The filer can also ask the court to dismiss the case at any time, if it has not already been converted under section 706 or 1112. Any agreement giving up the right to ask for dismissal is not valid. Someone with a stake in the case can ask the court to dismiss for cause after notice and a hearing. Causes include delay or gross mismanagement that hurts creditors; unpaid fees required under chapter 123 of title 28; missing the plan filing deadline (section 1221); failing to make plan payments; denial, revocation, or denial of a modified plan (sections 1225, 1229, 1230); continued loss of the estate with no likely recovery; and failure to pay domestic support obligations that become due after filing. If fraud related to the case is shown, the court may dismiss or convert the case to chapter 7. A case cannot be converted to another chapter unless the debtor is eligible under that chapter.
