Title 11 › Chapter 3— CASE ADMINISTRATION › Subchapter I— COMMENCEMENT OF A CASE › § 305
A bankruptcy judge can dismiss a case or pause all court action after telling the parties and holding a hearing if stopping would better help the debtor and creditors, or if a foreign proceeding has been recognized under section 1515 and pausing helps the goals of chapter 15. A foreign representative may ask for dismissal or a pause under that foreign-recognition option. The judge’s decision to dismiss, pause, or refuse to do so cannot be appealed to the courts of appeals under sections 158(d), 1291, or 1292 of title 28, or to the Supreme Court under section 1254 of title 28.
