The Board must make rules that limit the fees a card issuer can get for electronic debit transactions. Those interchange fees must be reasonable and match the issuer’s actual cost for that specific transaction. The Board had to finish standards within 9 months after July 21, 2010, can ask issuers or networks for cost and fee data, and must publish summary information at least every six months. The Board must treat per-transaction costs differently from general costs, and it can allow extra fee amounts only to cover fraud-prevention costs if issuers meet Board fraud standards. Issuers with less than $10,000,000,000 in assets are exempt. Some government-issued and prepaid cards are initially excluded, but certain general-use prepaid cards become covered after 1 year if they allow overdraft fees or certain ATM fees. The Board also must make rules about network fees so they cannot be used to get around these limits. The rules take effect 12 months after July 21, 2010. Compliance is enforced under section 1693o, and sections 1693m and 1693n do not apply. Definitions (short): affiliate — a company under common control with another; debit card — a card, code, or device used to take money from an account (includes general-use prepaid cards); credit card — as defined in section 1602; discount — a reduction from the stated regular price; electronic debit transaction — a payment using a debit card; Federal agency — an agency or Government corporation; institution of higher education — as defined in title 20; interchange transaction fee — a fee paid to an issuer for a debit transaction; issuer — the person who issues a debit or credit card; network fee — any non-interchange fee charged by a payment card network; payment card network — the system that routes and processes card transactions.
