Title 15 › CHAPTER 47 — CONSUMER PRODUCT SAFETY › § 2057c
It is illegal, starting 180 days after August 14, 2008, to make, sell, ship, or import children’s toys or child care articles that have more than 0.1 percent of DEHP, DBP, or BBP. On the same date, and until a final rule is made, it is also illegal to make, sell, ship, or import any toy that can be put in a child’s mouth or any child care article that has more than 0.1 percent of DINP, DIDP, or DnOP. As of August 12, 2011, these bans cover any plasticized part or other part of a toy or child care article that might contain phthalates. Parts a child cannot reach during normal or foreseeable use are not covered, but the safety agency can cancel that exception if science shows a risk. The agency must also issue guidance about what parts are “inaccessible” within 1 year after August 12, 2011. Breaking these rules is treated as a violation of the consumer product safety law. The safety commission must start appointing a Chronic Hazard Advisory Panel not earlier than 180 days after August 14, 2008. The panel must finish its study within 18 months of appointment and report within 180 days after finishing. The panel will study all phthalates and phthalate alternatives used in children’s products, looking at health effects (including hormone effects), combined effects, how much children and pregnant women are exposed to, total exposure from other sources, different ways of exposure (like touching or swallowing), what levels are safe, and alternatives. Within 180 days after it gets the panel’s report, the commission must decide whether to keep the interim bans and must issue a final rule that can ban more phthalates if needed to protect children. Phthalate alternative: a common substitute or different plasticizer. Children’s toy: a product made or intended for play by a child 12 years old or younger. Child care article: a product meant to help sleep, feeding, sucking, or teething for children 3 years old or younger.
