§3051 Definitions

Summary

Defines the key words used in the chapter about horse racing safety, drug testing, and related programs. Authority is the Horseracing Integrity and Safety Authority named under section 3052(a). Breeder is a person who breeds covered horses as a business. Commission is the Federal Trade Commission. Covered horse is a Thoroughbred, or another horse made covered, starting at its first timed, reported workout at a covered racetrack or training facility and ending when the Authority gets written notice that the horse is retired. Covered horserace is any race with covered horses that is tied to interstate commerce, including Thoroughbred races that take interstate off-track or advance-deposit bets. Covered persons are trainers, owners, breeders, jockeys, racetracks, veterinarians, people licensed by a State racing commission, their agents, employees, and other horse support staff working with covered horses. Equine constituencies are the group of owners, breeders, trainers, racetracks, veterinarians, State racing commissions, and jockeys. Equine industry representative is an organization active in the industry that represents those groups. Horseracing anti-doping and medication control program is the anti-doping program set up under section 3055(a). Immediate family member includes spouse, domestic partner, mother, father, aunt, uncle, sibling, or child. Interstate off-track wager has the meaning given in section 3002. Jockey is a rider or driver of a covered horse in covered horseraces. Owner is someone who owns part or all of one or more covered horses. Program effective date is July 1, 2022. Racetrack is an organization licensed by a State racing commission to run covered horseraces. Racetrack safety program is the safety program set up under section 3056(a). Stakes race is any race a racetrack labels as a stakes race, including the Breeders’ Cup World Championships and races graded by the American Graded Stakes Committee. State racing commission is the state entity given jurisdiction over horseracing by state law or regulation. Trainer is a person who trains covered horses. Training facility is a place that is not a licensed racetrack but mainly houses covered horses and runs official timed workouts. Veterinarian is a licensed vet who treats covered horses. Workout is a timed run over a set distance not part of a race or the horse’s first qualifying race, unless that race is made covered by election under section 3054(k).
