§6762 Right of Action

Summary
Anyone harmed or unhappy with an Association decision or action may file a lawsuit in the proper U.S. district court, but only after first reasonably trying to resolve the matter inside the Association. The court must give proper weight to the Association’s interpretation of its bylaws, standards, and this part of the law.

(a)Any person aggrieved by a decision or action of the Association may, after reasonably exhausting available avenues for resolution within the Association, commence a civil action in an appropriate United States district court, and obtain all appropriate relief.
(b)In any action under subsection (a), the court shall give appropriate weight to the interpretation of the Association of its bylaws and standards and this subchapter.
