States can choose to offer extra unemployment help called pandemic emergency unemployment compensation (PEUC) by making an agreement with the U.S. Secretary of Labor. A State can end the deal with 30 days’ written notice. PEUC pays people who have used up all regular unemployment for a benefit year (not counting benefit years that ended before July 1, 2019), who have no other unemployment rights for the week, who are not getting Canadian unemployment for that week, and who are able, available, and actively looking for work. “Actively looking” means registering for employment services, contacting employers as the State requires, keeping a record of contacts, and showing that record when asked; States must be flexible for people who cannot search because of COVID-19. People who were getting extended benefits for the week that included December 27, 2020 or the week that included March 11, 2021 must finish those extended benefits before getting PEUC tied to those later changes. PEUC weekly payments equal the person’s regular state weekly amount plus any Federal Pandemic Unemployment Compensation and any Mixed Earner payment that apply. Each claimant gets an account equal to 53 times their average weekly benefit (including Federal Pandemic Unemployment Compensation), and payments cannot exceed that account. If a State changes how it computes regular benefits so the average weekly amount or number of weeks drops below what it was on January 1, 2020, the agreement will not apply. The federal government pays States 100% of PEUC amounts and provides funds for administration. If someone knowingly lies to get PEUC, they lose eligibility, must repay amounts (unless the State waives repayment for no fault and fairness), may face criminal charges under 18 U.S.C. 1001, and the State may recover overpayments within 3 years after notice and a hearing. Agreements cover weeks starting after the agreement begins and ending on or before September 6, 2021.
