Title 16 › CHAPTER 38 — FISHERY CONSERVATION AND MANAGEMENT › SUBCHAPTER IV — NATIONAL FISHERY MANAGEMENT PROGRAM › § 1858
If someone breaks the covered fishing rules, the Secretary can fine them up to $100,000 for each violation. Each day the bad behavior continues counts as a separate violation. The Secretary must give notice and a chance for a hearing before deciding the fine. When picking the amount, the Secretary looks at what happened, how serious it was, who was at fault, any past offenses, and other fairness issues. The Secretary can consider the person’s ability to pay only if that information is given at least 30 days before the hearing. A person who gets a fine or a permit punishment can ask a federal court to review it by filing a complaint within 30 days. The Secretary will send the court the record behind the decision, and the court can set the decision aside if it finds there was not enough evidence. If a fine becomes final and is not paid, the Secretary will ask the U.S. Attorney General to sue to collect it. A vessel used in a violation can be held responsible and a lien placed on it; the government can sue the vessel itself. The Secretary can reduce, change, or cancel penalties. For hearings, the Secretary can order witnesses to come and bring papers, give oaths, and must pay witness fees and travel like federal courts; courts can enforce those orders. If a vessel was used in a violation, if an owner/operator violated the rules, or if related fines or observer fees are overdue, the Secretary may revoke, suspend, deny, or add conditions to permits. Selling a vessel does not remove a pending or active permit sanction, and the seller must tell the buyer about it. If a permit was suspended only for nonpayment, it will be restored when the money and interest are paid. No permit sanction may be imposed without a prior hearing on the facts.
