Title 16 › Chapter 44A— ANTARCTIC MARINE LIVING RESOURCES CONVENTION › § 2439
The Secretary of Commerce and the Secretary of the department that runs the Coast Guard must enforce this chapter. They may use people, services, or facilities from other federal agencies by agreement. Federal officers or employees they authorize to enforce the rules may serve legal papers, search people, places, vehicles, or aircraft without a warrant when there are reasonable grounds, board and inspect U.S. vessels with or without a warrant, and seize evidence. They can also seize Antarctic marine life, any U.S. vessel or other transport used in the offense, and equipment used in the offense; offer rewards for help catching violators; take sworn statements; work with the Treasury to inspect imports and exports; arrest people for certain offenses in section 2435 (paragraphs (4), (5), (6), or (7)) if there are reasonable grounds; use agreed observation or inspection systems under section 2434(b); and exercise any other lawful enforcement powers. Seized items must be held by authorized officers while civil or criminal cases move forward, or while the government starts a forfeiture action. A court can order release of seized items back to the wild or their destruction if keeping them costs more than their market value. Officers who release or destroy items as ordered are protected from penalties or damages. Owners may be allowed to post a bond instead of having the government keep the item. Antarctic marine life, vessels, vehicles, aircraft, and equipment used in violations are subject to forfeiture to the United States. After forfeiture or abandonment, the Secretary of Commerce or the Coast Guard Secretary will dispose of the property according to regulations and the chapter’s purposes. Rules about customs seizures and forfeitures apply when they fit, and the powers given to Customs officers may be used by these Secretaries or their designees for this chapter.
