Title 16 › Chapter 53— CONTROL OF ILLEGALLY TAKEN FISH AND WILDLIFE › § 3372
It is illegal to import, export, move, sell, receive, buy, or try to do any of those things with fish, wildlife, or plants that were taken or traded in violation of U.S., tribal, state, or foreign laws. It is also illegal to have such items in certain U.S. federal areas. Containers carrying fish or wildlife must be clearly marked as required by rules. Paying for or accepting money for guiding, outfitting, or for a hunting or fishing license counts as buying or selling fish or wildlife for purposes of the rule. Making or filing false papers, labels, or IDs for animals or plants being imported, exported, or moved between states is also illegal. There are rules about “prohibited” wild animals. Most dealing with those animals is banned unless a narrow list of exceptions applies, such as certain public exhibitors with a Class C Agriculture license that meet safety and care rules (including keeping big cats at least 15 feet from the public unless a permanent barrier is used), some state schools and veterinarians, certified wildlife sanctuaries that meet strict conditions, people just transporting an animal to an approved place, and people who already owned an animal born before December 20, 2022 if they register each animal with the Fish and Wildlife Service within 180 days after December 20, 2022, stop breeding or selling it after that date, and bar direct public contact. For plants, starting 180 days after enactment, people importing plants must file a declaration listing the plant’s scientific name, value, quantity (with units), and the country of origin. If the exact species or country is unknown, the importer must list all possible species or countries; recycled paper products must show average recycled content. Packaging-only plant material is excepted. The Secretary must review these plant rules within two years, take public comment, report to Congress within 180 days after that review, and may issue final regulations within 180 days after the review.
