Title 16 › CHAPTER 53 — CONTROL OF ILLEGALLY TAKEN FISH AND WILDLIFE › § 3371
Defines key words used in the chapter. Breed means helping or allowing animals to reproduce. Fish or wildlife means any wild animal, alive or dead, and any part, product, egg, or offspring of those animals. Import means bringing something into any place under U.S. jurisdiction, even if customs laws call it something else. Indian tribal law means a rule an Indian tribe enforces, but only when it applies inside Indian country (see section 1151 of title 18). The words law, treaty, regulation, and Indian tribal law mean rules that cover taking, possession, importation, exportation, transportation, or sale of fish, wildlife, or plants. Person includes people, businesses, groups, trusts, and government officers, employees, agents, departments, or agencies of the U.S. or any State, and other entities under U.S. jurisdiction. Plant means any wild plant, including roots, seeds, parts, products, and trees from natural or planted forests. Plants do not include common cultivars (except trees) and common food crops, scientific specimens of plant genetic material used only for lab or field research, or plants that will stay planted or be replanted. Those research and planted exceptions do not apply if the plant is listed in a CITES appendix (27 UST 1087; TIAS 8249), listed as endangered or threatened under the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.), or covered by a State law for species native to that State and threatened with extinction. Prohibited wildlife species means live lions, tigers, leopards, cheetahs, jaguars, cougars, or hybrids of those animals. Secretary means the Secretary of the Interior or the Secretary of Commerce as assigned under Reorganization Plan No. 4 of 1970 (84 Stat. 2090); for plant import/export it also means the Secretary of Agriculture. State names the 50 states, the District of Columbia, Puerto Rico, the Virgin Islands, Guam, Northern Mariana Islands, American Samoa, and other U.S. territories, commonwealths, or possessions. Taken means captured, killed, or collected, and for plants also means harvested, cut, logged, or removed; taking means doing any of those acts. Transport means to move, carry, ship, or deliver for movement by any means, or to receive something for that purpose.
