Title 16 › Chapter 53— CONTROL OF ILLEGALLY TAKEN FISH AND WILDLIFE › § 3374
Fish, wildlife, or plants taken, held, moved, sold, bought, or otherwise handled in violation of section 3372 (except section 3372(b)) can be seized by the U.S. government. That seizure can happen even if the level of fault needed for penalties or criminal charges under section 3373 is not met. Boats, cars, planes, and other gear used in a felony that involves selling or trying to sell or buy those animals or plants can also be taken if the owner agreed, knew, or should have known (with reasonable care) it would be used in the crime. The same rules that apply to customs seizures and forfeitures generally apply here, and Treasury officers’ customs powers can be carried out by the Secretary or people the Secretary names. Search or seizure warrants must follow Rule 41 of the Federal Rules of Criminal Procedure. Anyone convicted or fined under section 3373 must pay the cost of storing and caring for seized items. Civil forfeitures follow chapter 46 of title 18.
