Title 16 › CHAPTER 10B — FISH RESTORATION AND MANAGEMENT PROJECTS › § 777h
The Secretary of the Interior may only spend the money from section 777c(b) on admin costs that directly help run the program. Allowed costs include pay for staff time spent administering the program (certified by their supervisor); support costs tied to those staff; work to decide if State plans and projects are substantial under section 777e(a); overhead based on actual costs using a cost-allocation method approved by the Director of the Office of Management and Budget (or, if that is not possible, no more per employee than other Fish and Wildlife Service programs charge per full‑time worker); audits of State fish and game activities every 5 years; the audits required under subsection (d); training for Federal and State staff; travel to States, territories, and Canada for program work or to manage grants; travel outside the U.S. (except Canada) only with the Assistant Secretary’s approval; relocation payments for staff who will work on the program for at least 1 year (paid only in the same share as the time they spend on the program); and costs to review and oversee grants under sections 777e and 777m. If the Secretary wants to use the funds for some other admin expense, a report describing the expense and amount must go to the Senate Environment and Public Works Committee and the House Resources Committee. The Secretary may use the money for that expense only after 30 days from the report, and no more than $25,000 per fiscal year may be used this way. These funds cannot be used to add to any job or program already funded by general appropriations for the Fish and Wildlife Service or other Interior offices. The Inspector General must hire an independent auditor, chosen by competitive contract, to perform audits every two years under generally accepted accounting rules. The auditor reports to the Inspector General and also sends a copy to the Secretary. The Inspector General must promptly give the audit results and a copy to the House Resources Committee and the Senate Environment and Public Works Committee.
