Allows certain advertisements and the mailing or transport of lottery materials that would otherwise be banned by sections 1301–1304. Ads or prize lists for a lottery run under a State’s law are allowed if they appear in a publication published in that State or are aired by a radio or TV station licensed in that State. Ads for lotteries or similar schemes are also allowed if the activity is legal in the State and is run by a not-for-profit or is a clearly occasional, secondary promotion by a business. Mailing or shipping of tickets or materials is allowed to addresses inside the State for State-run lotteries, and to addresses in a foreign country for lotteries legal under that foreign country’s law. Definitions: State = a U.S. State, the District of Columbia, Puerto Rico, or any U.S. territory or possession. Foreign country = any country, colony, protectorate, or similar place outside the U.S. Lottery = pooling ticket sales and giving out prizes by chance; it does not include betting on sports. Not-for-profit organization = one that would qualify as tax exempt under section 501 of the Internal Revenue Code of 1986.
