It is a crime for someone who acts or says they act for the United States or a State but has no legal authority to issue or confirm a passport or a passport-like document for anyone. It is also a crime for a consular officer to knowingly give such a passport to a person who does not owe allegiance to the United States (whether or not that person is a U.S. citizen). If found guilty, the person can be fined and go to prison: up to 25 years if done to help international terrorism, 20 years if to help a drug‑trafficking crime, 10 years for a first or second offense not tied to those crimes, or 15 years for other offenses. State means a U.S. State, the District of Columbia, and any commonwealth, territory, or possession of the United States.
