Defines key words used in the chapter about sexual images and minors. Minor: any person under the age of eighteen years. Sexually explicit conduct: actual or simulated sexual acts like intercourse (genital-genital, oral-genital, anal-genital, or oral-anal), bestiality, masturbation, sadistic or masochistic abuse, or a lewd showing of the genitals or pubic area. For the child-porn rules in term 8(B), it also covers graphic or simulated sexual acts and explicit displays. Producing: making, directing, publishing, or advertising images. Organization: any person that is not an individual. Visual depiction: any photo, film, video, undeveloped film, or digital data that can be turned into an image or has been sent electronically. Computer: has the meaning given in section 1030 of this title. Custody or control: supervision or responsibility for a minor, even if temporary or obtained illegally. Child pornography: any visual image of sexually explicit conduct where making it involved a minor; or the image is a digital or computer image that is, or looks like, a minor; or it was created or changed to make an identifiable minor appear to be involved. Identifiable minor: someone who was a minor when the image was made or whose image as a minor was used, and who can be recognized by face, likeness, or a unique mark; proving their real name is not required. Graphic: a viewer can see any part of the genitals or pubic area during the depiction. Indistinguishable: the image looks so real that an ordinary person would think it shows an actual minor in sexual activity; this does not include drawings, cartoons, sculptures, or paintings.
