The party who asked for a commission must pay the consular charges (listed under 22 U.S.C. 1201) and any witness fees for testimony taken under sections 3492–3494. Each witness called under section 3493 gets the daily fee set in section 3496. If the United States asked for the commission, the U.S. pays foreign lawyers chosen under the commission and interpreters the consular officer needs, based on verified bills the consular officer approves. If another party asked for the commission, that party pays their foreign lawyer and may have those costs allowed the same way. If someone swears before a commission is issued that they cannot afford the fees, the court can order the fees paid in the same manner as fees charged to the United States. Funds already set aside to pay fees for witnesses subpoenaed for the United States in criminal cases may be used to pay fees the United States must cover under these rules.
