After January 29, 2020, the President can announce actions and other federal officers can make rules to carry out the USMCA. If a presidential announcement is not covered by the consultation and waiting rules in section 4514, it cannot start until the 15th day after the announcement appears in the Federal Register. That 15-day wait can be waived if needed so the action can start on the day the USMCA enters into force. Initial rules needed to implement this law or the approved administrative plan should, as much as possible, be put in place within 1 year after the USMCA enters into force. Rules for the Uniform Regulations on rules of origin under article 5.16 must be in place by the date the USMCA enters into force. If an implementing action takes effect later, its initial rules should be put in place within 1 year after that later effective date. The President may change, continue, or add duties, duty-free or excise treatment, and other tariff measures (including staging changes agreed with USMCA partners), and must convert specific or compound duty rates in Annex 2–B to equivalent ad valorem rates when needed. The President must also act to make sure tariff-rate quotas for agricultural goods do not disrupt orderly marketing. The President may add certain listed USMCA provisions into the Harmonized Tariff Schedule (for example parts of Annex 4–B, Annexes 3–A and 3–B, and parts of Appendix 2 to Annex 2–B) and may modify those entries with the required consultation and waiting process; but changes to chapters 50–63 are generally limited to correcting typographical, clerical, or other nonsubstantive technical errors within 1 year after the USMCA enters into force, except where needed to implement an agreement under article 6.4.
