Title 20 › CHAPTER 28 — HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE › SUBCHAPTER IV — STUDENT ASSISTANCE › Part A — Grants to Students in Attendance at Institutions of Higher Education › subpart 2 — federal early outreach and student services programs › § 1070a–25
Eligible entities that get a grant must set up or keep a scholarship program for students and follow these rules. Partners named in the grant can also give scholarships. The entity must spend at least 25% and no more than 50% of the grant on certain program activities described in another part of the law (one specific activity is excluded), and use the rest for scholarships. The Secretary may allow spending more than 50% on those activities if the entity shows it has another way to give students the required financial help and explains that in its application under section 1070a–23. The program must tell students the scholarship rules when they start. Each entity sets the maximum scholarship amount. The yearly minimum scholarship must be at least the minimum Federal Pell Grant award under section 1070a for that award year. Entities must hold in reserve enough money equal to the minimum scholarship times the number of students they expect will qualify to use the funds after finishing high school and enrolling in college. Reserved funds can pay tuition, fees, books, supplies, required equipment, and, for students with special needs, related services. Money not used within six years after a student’s expected high school completion may go to other eligible students or be returned to the Secretary for other grantees. Scholarships here are not counted when making other Federal grant awards, and total aid cannot exceed a student’s cost of attendance. Eligible students must be under 22 at their first award, have finished high school (or equivalent) on or after January 1, 1993, be enrolled or accepted in an in-state undergraduate program (unless the State allows out-of-state portability), and have taken the required program activities.
