Title 20 › CHAPTER 28 — HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE › SUBCHAPTER IV — STUDENT ASSISTANCE › Part A — Grants to Students in Attendance at Institutions of Higher Education › subpart 2 — federal early outreach and student services programs › § 1070a–22
When the Secretary gives out the yearly grant money, at least 33 percent must go to one group of eligible recipients and at least 33 percent must go to a second group. The rest is given based on how many good applications there are and how promising they look. The Secretary should try to spread awards across different regions and between urban and rural areas when possible. Each awardee must coordinate its work with other awardees serving the same school district or State and with related federal or nonfederal programs. Awardees in the second group must name a college or the local school district to handle the grant funds. Awardees in the second group must serve at least one grade level starting no later than 7th grade in a school that has a 7th grade and where at least 50 percent of students get free or reduced-price lunches. If it would work better, they can instead serve a whole grade of students living in public housing. Services must continue through 12th grade and may continue into a student’s first year of college if the application promised that. They must also serve students who got services from a previous grant but have not finished 12th grade. Grants must add to existing Federal, State, and local funding and not replace those funds.
