Title 20 › CHAPTER 28 — HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE › SUBCHAPTER IV — STUDENT ASSISTANCE › Part A — Grants to Students in Attendance at Institutions of Higher Education › subpart 4 — leveraging educational assistance partnership program › § 1070c–1
The Secretary must give each State money from the funds under section 1070c(b)(1) that are not held back under section 1070c(b)(2). Each State’s share is the same share of the money as its share of the total number of students who are eligible for the program, using the most recent year with reliable data. No State can get less than it got in fiscal year 1979. If a State will not need all of its money for the year, the unused amount can be given to other States during that year. The extra money is split based on the States’ original shares, but a State’s added share is cut back if the Secretary thinks the State does not need or cannot use that much. Any money moved to a State this way counts as part of its original allotment. The Secretary will only pay continuing incentive grants to States that keep meeting the rules in section 1070c–2(b).
