The Secretary may waive certain eligibility rules for colleges and universities that meet one of five conditions: the school gets heavy state support and charges low or no tuition; it has a large share of low-income students; it is helping more low-income, disadvantaged, underrepresented, or minority students get higher education; it is expanding access in rural or isolated places with no nearby colleges; or the waiver would significantly increase opportunities for Hispanic Americans. The Secretary can also waive another rule if a school submits strong evidence that special factors distorted the usual measurement and the school otherwise fits the program’s purpose. Every other year the Secretary must report to Congress which schools were made eligible this way, explain the distorting factors considered, and list each school with the reasons for its eligibility.
