Title 20 › Chapter 33— EDUCATION OF INDIVIDUALS WITH DISABILITIES › Subchapter II— ASSISTANCE FOR EDUCATION OF ALL CHILDREN WITH DISABILITIES › § 1418
States that get money under this law and the Secretary of the Interior must send yearly data to the U.S. Education Secretary and to the public. They must show counts and percentages of children with disabilities by race, ethnicity, English‑language ability, gender, and disability. The reports must cover who gets a free public education, who is in regular classes, who is in separate classes, schools, or residential facilities, and for each age from 14 through 21 who stopped getting special education and why (including graduation). The data must also show students moved to interim alternative settings and the acts that led to those moves, long‑term suspensions and expulsions, suspensions of 1 day or more and how long discipline lasts, how many children get early intervention and how many infants/toddlers at risk receive services, comparisons of removals/expulsions for students with and without disabilities, numbers of due process complaints and hearings, discipline hearings and resulting placement changes, and counts of mediations and settlement agreements. The Secretary may ask for other information and may allow sampling. All reports must protect student privacy so no child can be identified. The Secretary can give technical help to states. States must also collect and study data to see if certain racial or ethnic groups are overrepresented in identification, placement, or discipline. If the data show significant disproportionality in identification or placement, the state must review and fix the policies and practices, require the local school district to set aside the maximum funds allowed to provide coordinated early intervention services (especially for the overidentified groups), and make the district publicly report the changes.
