Title 20 › Chapter 33— EDUCATION OF INDIVIDUALS WITH DISABILITIES › Subchapter III— INFANTS AND TODDLERS WITH DISABILITIES › § 1438
A State may use the money given under section 1433 to run the statewide system and also for other supports for infants and toddlers with disabilities and their families. The funds can pay for direct early intervention services not paid for by other sources, make existing services bigger or better, or provide a free appropriate public education under subchapter II for children with disabilities from their 3rd birthday until the start of the next school year. If the parents give written consent, the State can keep giving early intervention services from the child’s 3rd birthday until the child starts, or is eligible to start, kindergarten instead of the school program under subchapter II. If a State does not serve at-risk infants and toddlers under section 1437(a)(4), it can use the money to build or improve partnerships with community groups to find and evaluate at-risk children, refer them for services, and do periodic follow-up to see if their eligibility for services has changed.
