When the yearly funds under section 6302(b) are no more than the amount in section 6311(b)(2)(I), the Secretary must set aside one‑half of 1 percent for the Bureau of Indian Education, one‑half of 1 percent for outlying areas, and up to 20 percent to carry out section 6362. The rest is used for section 6361. Each State gets $3,000,000, unless the money is not enough — then that $3,000,000 is cut evenly for every State. Any leftover money after the $3,000,000 payments is split among States based on how many students age 5 through 17 each State has. If funds under section 6302(b) are more than the amount in section 6311(b)(2)(I), the extra money is first used for competitive grants to State educational agencies or consortia for the specific activities listed in section 6361(a)(2). States or consortia must apply. Grants are sized by each State’s share of students age 5 through 17. Any remaining funds are then given to States or consortia that did not get a grant, again by each State’s share of students age 5 through 17. “State” means the 50 States, the District of Columbia, and Puerto Rico. The Secretary must follow the prohibitions in section 7909 when making these funds available.
