Title 22 › Chapter 46A— FOREIGN DIRECT INVESTMENT AND INTERNATIONAL FINANCIAL DATA › § 3142
The Secretary of Commerce must send a report about foreign direct investment in the United States within 6 months after November 7, 1990, and then at the end of each 1-year period after that. The report goes to the House Committees on Energy and Commerce, Ways and Means, and Foreign Affairs; to the Senate Committee on Commerce, Science, and Transportation; and to the Joint Economic Committee. The report must cover the history, size, trends, market concentrations, and effects of foreign investment on the U.S. economy. If any of those committees asks, the Secretary must appear and give testimony about the report. When making the report, the Secretary or a designee must use information from several sources, including the Bureau of Economic Analysis (under the International Investment and Trade in Services Survey Act), the Census Bureau (title 13), the Bureau of Labor Statistics (only non-identifying data), Executive Order 11858 work, the USDA (Agricultural Foreign Investment Disclosure Act), the Treasury (26 U.S.C. 6039C, non-identifying), the Department of Energy (42 U.S.C. 7267(8), non-identifying), other federal agencies (non-identifying), foreign governments, and private sources. The report must compare foreign-controlled firms to other U.S. firms on things like employment, market share, value added, productivity, research and development, trade, profits, taxes, and state or local incentives. The comparison must be by major industries and regions and must not identify any person or business. The report must also, where data exist, show how many firms with at least 10 percent foreign ownership and their market share are involved in producing critical technologies named in the most recent assessment under section 4816 of title 10 or the most recent report to the President under section 6683 of title 42.
