Title 22 › Chapter 46A— FOREIGN DIRECT INVESTMENT AND INTERNATIONAL FINANCIAL DATA › § 3144

Summary

Certain workers who see protected information must swear the same oath and follow the same secrecy rules and penalties that apply to Census staff under Title 13. Only workers who have sworn under the International Investment and Trade in Services Survey Act may see information covered by that Act, and they face the same penalties under that Act. Those workers are also bound by any other laws that limit sharing the information. If anyone who has the information reveals it so it can be tied to a person or business, or if someone gets access to the information by lying or cheating, they can be fined at least $2,500 and at most $25,000, jailed for up to 5 years, or both. Data gathered under this law cannot be forced into court or used as evidence in federal, state, or local cases, except when it is needed to enforce rules about collecting the data or to enforce the penalties just described. The Secretary of Commerce will manage information sharing between the Census Bureau and the Bureau of Economic Analysis and settle access disputes between them; the Census and BEA must agree in writing on what data will be shared. The Director of the Office of Management and Budget will manage and settle disputes about information sharing between the BEA and the Bureau of Labor Statistics.
