Grants for a tribe or tribal organization must include three pieces of money each year: the full amount the schools get under the Education Amendments funding rules (including transportation money), any operations and maintenance and certain facilities funds if the tribe asks for them, and the full amounts the schools get under Title I, the Individuals with Disabilities Education Act (IDEA), and any other federal education programs. Money for school buildings, repairs, health and safety, or new construction that is put into the grant must be kept in a separate account, used only for the project it was meant for, and followed by a separate report when the work is done. If a facilities or construction grant is over $100,000, special administrative and audit rules apply, the Secretary and the tribe must agree on a payment schedule, the Secretary must consider whether the tribe can meet building and safety rules, disputes follow the program’s dispute process, and a school may do new construction with these funds only if the tribe pays at least 25% of the total cost. If no time period for work is set, the Secretary and tribe must agree on one before money moves and can extend it by agreement. Money that comes from the Education Amendments or from operations and maintenance accounts and is placed into these grants must follow the grant program’s rules and cannot be hit with extra Bureau-only limits that would otherwise apply to Title I, IDEA, or other federal education funds. Tribally controlled schools in the program are treated like contract schools for some Education Amendments funding formulas and like Bureau schools for other funds that the Bureau distributes. If the Secretary does not add requested operations or maintenance funds to a grant within 180 days, the request is automatically approved and the grant must be changed, and the tribe can enforce these rights through the program’s dispute process.
