§3072 Definitions

Summary

Defines key words used in the chapter about Native American human remains, cultural objects, and rules for export or trafficking. It names who and what the rules cover and which items need a certificate or are banned from export. Archaeological resource — an archaeological thing that is Native American (see section 470bb of title 16). Cultural affiliation — a shared group identity that can be traced between a living Tribe or Native Hawaiian group and an earlier group. Cultural item — any item as defined in section 2 of the Native American Graves Protection and Repatriation Act (25 U.S.C. 3001). Indian Tribe — the meaning given in 25 U.S.C. 3001. Item Prohibited from Exportation — cultural items or archaeological resources banned from trafficking under laws such as 18 U.S.C. 1170(b) or 16 U.S.C. 470ee(b)–(c), or other federal law or treaty. Item Requiring Export Certification — cultural items and archaeological resources, unless an affiliated Tribe or Native Hawaiian organization issues a certificate allowing export. Native American — includes the Native American and Native Hawaiian definitions in 25 U.S.C. 3001. Native Hawaiian organization — the meaning in 25 U.S.C. 3001. Secretary — the Secretary of the Interior. Tangible cultural heritage — Native American human remains or objects, resources, or patrimony important for culture, history, or archaeology and tied to Native American cultures.
