The Secretary can make contracts with State education agencies or school districts to help them buy land or to build, buy, or fix school buildings and equipment for districts on or near Indian reservations or other trust lands when those facilities are needed for Indian children’s education. At least 75% of the money must go to projects that meet the eligibility rules in sections 644(a) and 644(b) of title 20, using any funding priorities the Secretary of Education has set. The Secretary of Education must give a list of eligible projects at the start of each fiscal year, beginning with the first full fiscal year after January 4, 1975. Up to 25% of the funds may be used for schools eligible under section 5355. Any contract must require the State agency to give Indian students the same or better education standards as non-Indian students in that district and to follow the same State and local building codes and school standards. The Secretary must consult, before making a contract, with the entity named in section 5346 and with the tribe’s governing body if the tribe’s education will be significantly affected; that consultation is only advisory and is not required when the applicant is an elected school board with a majority of Indian members. Within 90 days after the three-year period following January 4, 1975 ends, the Secretary must evaluate the program and report to Congress. The report must include an analysis of construction costs and certain legal impacts, descriptions of how the Departments of the Interior and Education and local or State agencies worked together (including any memoranda of understanding), projections of future school construction needs for Indian children on or near reservations, and recommendations about moving some administration from the Department of Education to the Department of the Interior. Congress authorized $35,000,000 for the fiscal year ending June 30, 1974; $35,000,000 for each of the next four fiscal years; and after that whatever sums are needed, all to remain available until spent.
