In the Court of International Trade, cases under sections 515, 516, or 516A treat decisions by the Secretary of the Treasury, the administering authority, or the International Trade Commission as correct, and anyone challenging them must prove otherwise. Not for section 1582 cases. In actions under section 1581(h), the party who starts it must prove the required showing by clear and convincing evidence. If merchandise value is disputed, certain reports, depositions, affidavits, and authenticated price lists or catalogs may be admitted if served under the court’s rules.
