Title 29 › CHAPTER 7 — LABOR-MANAGEMENT RELATIONS › SUBCHAPTER IV — LIABILITIES OF AND RESTRICTIONS ON LABOR AND MANAGEMENT › § 186
Makes it illegal for an employer, group of employers, or a person acting for an employer (like a consultant) to give, lend, promise, or deliver money or anything of value to employee representatives, labor unions, union officers, or to employees or employee committees beyond their normal pay if the purpose is to influence union organizing, choice of collective bargaining representatives, or a union officer’s actions. It is also illegal for anyone to ask for, accept, or agree to accept such payments. Unions may not demand fees from drivers or their employers for unloading cargo. Payments are allowed in certain cases. Allowed examples include pay to employees whose job is labor relations, court judgments or settled claims, normal business sales, dues taken from wages with a written one-year (or contract-end) assignment, and contributions to properly run trust funds for benefits (medical, pensions, insurance, unemployment, vacations, training, scholarships, child care, housing, or legal services) if the trust has a written agreement, joint employer-employee administration, audits, and dispute procedures. Some limits apply to legal services provided by such funds. Payments to labor-management committees under the Labor Management Cooperation Act are also allowed. Willful violations are crimes: if the value involved is more than $1,000 it is a felony punishable by up to $15,000 fine and 5 years in prison; if $1,000 or less it is a misdemeanor punishable by up to $10,000 fine and 1 year in prison. Federal courts can stop violations. The rules did not apply to contracts already in force on June 23, 1947 until those contracts ended or until July 1, 1948, whichever came first. Some trust-fund rules do not apply to funds made by collective agreement before January 1, 1946, and contributions were allowed to funds that had pooled vacation benefits before January 1, 1947.
