States must follow the performance rules in section 3141(b) for their vocational rehabilitation programs. A State may add extra performance measures, but it must list those in its State plan under section 721. After each fiscal year ends, the State must report to the Commissioner, under rules set by the Secretary, about how well it met the standards and indicators. If the Commissioner finds a State is below the standards, the Commissioner must give technical help and work with the State to make a program improvement plan. The Commissioner will review the plan on a biannual basis and require changes until the State keeps acceptable performance for more than 1 year. If a State will not make or follow a plan, the Commissioner may reduce or stop program payments to that State, following subsections (c) and (d) of section 727. Beginning in fiscal year 1999, the Commissioner must include an analysis of program and State performance in the annual report to Congress under section 710.
